  • ANY DAMAGES ARISING FROM ANY THIRD-PARTY CONDUCT OR CONTENT

11.2. Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Lekeshia Angelique Consulting, its officers, directors, employees, contractors, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

13. Governing Law and Dispute Resolution

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally for at least thirty (30) days.

13.3 Binding Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Montgomery County, Tennessee.

13.4 Class Action Waiver

YOU AND LEKESHIA ANGELIQUE CONSULTING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13.5 Injunctive Relief Exception

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

14. Privacy

15. Termination

15.1. Termination by You

You may terminate your account at any time by:
